This data privacy policy (“Privacy Policy”) sets out the manner in which SG International Marathon Pte. Ltd. (UEN No. 202538478G) (“SGIMPL”, “we”, “our” or “us”) may collect, use, disclose or otherwise process the data, whether true or not, about an individual who can be identified either (a) from that data; or (b) from that data and other information to which we have or are likely to have access (“Personal Data”) in accordance with the Personal Data Protection Act 2012 of Singapore, as may be amended from time to time (“PDPA”). This Privacy Policy applies to all users of our website / Application at https://singaporeinternationalmarathon.com/privacy-policy/ (“Platform”).

This Platform is brought to you by SG International Marathon Pte. Ltd. We take the privacy of our Platform users very seriously. We ask that you read this Privacy Policy carefully as it contains important information about how we will collect, use and/or disclose your personal data in accordance with Singapore’s Personal Data Protection Act 2012 (“PDPA 2012”). Throughout this Policy, the meaning of the term “personal data” is as defined in the PDPA 2012. Unless otherwise stated, references to the “Event” shall refer to the BYD Singapore International Marathon presented by adidas as well as any future editions organised by us.

  1. DATA CONTROLLER
    1. For the purposes of the PDPA 2012, SGIMPL is the organisation that collects, uses and/or discloses your personal data. If you wish to contact SGIMPL, you can find additional contact details at the end of this Privacy Policy.
  2. COLLECTION OF INFORMATION
    1. We are responsible for the overall planning, organisation, marketing, and delivery of the BYD Singapore International Marathon presented by adidas, and for managing all rights, commercial arrangements, and partnerships relating to the Event (the “Services”). We operate in partnership with Sport Singapore (“SportSG”), the statutory board under the Ministry of Culture, Community and Youth of Singapore. In order for us to render the Services, it is necessary for us to collect and use certain Personal Data. When we use the term “Services”, it also refers to any of the services or Platform that we own or operate that post or link to this specific Privacy Policy, including:
      1. Our Website;
      2. Our Application;
      3. Our marketing activities;
      4. Downloadable applications; and
      5. Our social networking pages, profiles, and feeds.
    2. While the specific types of Personal Data you submit through our Platform may vary depending on the relevant Services provided and whether you maintain an account with us, there are several categories of Personal Data which may be collected by SGIMPL and/or our affiliates:
      1. Name.
      2. Identity Data, which includes your country of residence, job title, age, business identification details. It may also include medical data (including information about medical conditions, current medications, and allergies to medication), emergency contact information, relay information and other information you provide during registration.
      3. Contact Data, which includes your e-mail address, mailing address, fax, and/or telephone number derived from your device’s SIM card.
      4. Transaction Data, which includes bank account information, payment instructions, your credit card details, your billing address, your mailing address or the mailing address of the intended recipient of your order, payments and orders to and from you, and other details of products and services that you have supplied to or purchased from us.
      5. Usage Data, which includes information about how you use our Platform (including the time you visit our Platform, the duration of your visit, the types of products and/or Services you are searching for and/or how you are searching for such products and/or Services).
      6. Marketing and Communications Data, which includes your interests, feedback, survey responses, preferences in receiving marketing materials from us and your communication preferences, as well as your preferences for particular products or services.
      7. Technical Data, which includes your Internet Protocol (“IP”) address, the internet device identity or media access control address of your device, information regarding the manufacturer, model or operating system of the device that you use and/or information about the web browser that you use to access our Platform (the “Technical Data”). This may also include access to your device’s camera or photo library.
      8. Location Data, including information derived from your device’s location services such as your live location.
      9. Social Network Information, which includes information from your social networks, including your profile information, picture, user ID associated with your social media account, friends list, and any other information you permit the social network to share with third parties. The personal data we receive is dependent upon your privacy settings on the respective social media platforms.
      10. Athlete Information, which includes anti-doping tests which may be conducted in compliance with the World Anti-Doping Code Information. Data collected in this context is only used to test for prohibited substances and, where applicable, impose sanctions on athletes using such prohibited substances.
      11. Any other Personal Data that you may voluntarily provide to us in the course of your use of our Services.
    3. How we collect your Personal Data
      We collect your Personal Data:

      1. Directly from you. You may give us your identity, contact, usage, transaction, communications, technical, and location data when you do any of the following (whether on your own behalf or on behalf of your organisation):
        1. Access or use our Platform or Services, including when you register for an account to access our Services or any subsequent use of the account for ongoing access to our Services.
        2. Submit any form, whether electronically or in hard copy, including, but not limited to, account or service application forms, onboarding or registration forms, Know-Your-Customer (“KYC”) or Anti-Money-Laundering (“AML”) verification forms, trade finance or credit facility applications (for example, factoring, forfaiting or invoice financing services), or any other forms relating to our products or Services. This includes providing any supporting documents or information required for due diligence, onboarding or compliance purposes (such as identity documents, proof of address, corporate registration or ownership information, or financial statements).
        3. Enter into a contract or commercial arrangement with us.
        4. Participate in a promotion, survey, event or other marketing campaign organised by us.
        5. Subscribe to our newsletters or alerts.
        6. Communicate with us by e-mail, phone, or other channels (for example, to request information, provide feedback, or resolve an issue).By submitting such forms, documents or information, you consent to our collection, use and disclosure of the Personal Data contained in them for the purposes described in this Privacy Policy and any other purposes notified to you at or before the time of collection.
      2. From your authorised representatives. We may also collect your identity, contact, usage, transaction, technical and location data from persons who are authorised to act for you, including those whom you have appointed, or who have been validly identified as acting on your behalf in accordance with our security procedures. You should ensure that such representatives are duly authorised to provide your Personal Data to us. We may also  receive personal data about you from third parties such as social media sites, data enhancement services, law enforcement agencies, or other third parties. In the course of the Event we will receive personal data on your performance from our service providers in connection with the Event.
      3. Automatically when you interact with our Platform. As you interact with our Platform, we may automatically collect your technical data about your equipment, browsing actions and patterns through cookies or similar technologies. We may collect such Personal Data by using website / application cookies.
      4. Third parties or publicly available sources. We may receive your Personal Data from third parties or public sources, which may be located in various jurisdictions. These include:  
        1. Technical Data from analytics providers such as Google. 
        2. Contact and transaction data from providers of technical, payment, or delivery services.
        3. Credit reference agencies, KYC/AML service providers, or compliance databases.
        4. Business counterparties, partners, or introducers involved in a transaction.
        5. Public registries, regulatory filings, or commercially available data sources used for due diligence or verification purposes.
      5. Event registration and payment platforms. Registration for the SGIMPL and the collection of registration fees are conducted via a third-party registration and/or payment platform (the “Registration Platform”). When you register, your Personal Data is collected directly by the Registration Platform in accordance with its own terms and privacy policy. The Registration Platform acts as an independent data controller in respect of the Personal Data it collects for its own purposes (including account management, payment processing, fraud prevention, and legal compliance). SGIMPL receives from the Registration Platform only the Personal Data necessary to administer your participation in the Event, such as your name, contact details, registration category, emergency contact details, and transaction status. In respect of this data, SGIMPL acts as an independent data controller for its own purposes as described in this Privacy Policy.
  3. PURPOSES FOR PROCESSING YOUR PERSONAL DATA
    1. We may collect, use, disclose, and/or otherwise process your Personal Data for any or all of the following purposes: 
      1. To register you (or your organisation) as a new customer or user of our Services. If you set up an account, we use your personal data to provide you with the account and its features. If you register for our Event or if you contact us to register for our Event, we use your personal data to conduct our Event and make your participation in our Event possible.
      2. To verify your identity and perform KYC and AML checks.
      3. To process, facilitate, and administer your trade, financing or other commercial transactions, including the provision of related services such as factoring, forfaiting, or credit facilities.
      4. To manage your account or relationship with us, including managing payments, fees, charges, collections, and recoveries of amounts owed to us. 
      5. To administer, operate, provide, maintain, protect and improve our business, Platform, and Services (including troubleshooting, data analysis, testing, system maintenance, technical support, reporting, hosting of data, and ensuring that unauthorised users do not access the information on our Platform). 
      6. To conduct credit assessments, obtain or provide credit references, and manage credit, operational, and other business risks in accordance with our internal policies.
      7. To carry out due diligence, screening, background checks, or other verification activities in accordance with our legal and/or regulatory obligations, or our internal risk-management procedures.
      8. To comply with applicable laws, regulations, codes of practice, guidelines, or rules, and to assist in law enforcement or regulatory investigations.
      9. To produce statistics, analytics or research for internal reporting, business planning, or statutory record-keeping.
      10. To conduct audits or surveys, including to validate the size and composition of our audience and assess user experience with our Services.
      11. To conduct research, analysis and development activities (including data analytics, profiling, product and service development) to improve or enhance our Services.
      12. To notify you of regulatory updates, service changes, product improvements or corporate announcements.
      13. To make suggestions and recommendations to you about products, Services, or promotions that may be of interest to you. 
      14. To access, host, and back up (whether for disaster recovery or otherwise) your Personal Data, whether within or outside Singapore.
      15. To prevent a serious threat to the life, health or safety of any individual (including yourself), or to public health and safety. For example, to ensure your safety during our Event we monitor you during the Event and share your medical data with our medical teams to help you in case of a medical emergency. We may also use your personal data to assist in the location of any person who has been reported as missing.
      16. To contact or communicate with you for any of the purposes set out above.
      17. Any other purpose for which you have provided the Personal Data, or for which you have been notified and consented to at the time of collection.
      18. Any other incidental business purpose related to or reasonably connected with the above.
    2. The purposes listed above may continue to apply even in situations where your relationship with us (for example, pursuant to a contract) has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under any contract with you).
    3. In some cases, we may ask you to grant us consent to process your information in a certain way. This includes situations where we process sensitive data, such as information about your health and medical conditions, when we ask to collect personal information for our marketing purposes, such as when you sign up for our e-mail newsletter and when we use your personal data for email marketing campaigns, and when setting certain cookies.
    4. Cookies
    5. We, and our third-party partners, may use cookies and similar technologies (including web beacons, pixels, and device identifiers) to collect certain information automatically when you access or use our Platform, applications, emails, or online services. Cookies are small data files stored on your device to facilitate website / application functionality, security, performance, and personalisation.
    6. We use cookies to:
      1. enable core site functions, including login and navigation;
      2. remember your preferences and improve your browsing experience;
      3. understand how our services are accessed and used, including for analytics;
      4. support event-related functions such as registration, verification, and user identification; and
      5. where permitted, deliver content or communications that may be more relevant to your interests.
    7. Our third-party service providers may also use cookies to provide hosting, analytics, advertising-related, social media, or functionality services on our behalf. These parties may collect information about your usage of our Platform or digital services over time.
    8. We use a cookie consent management platform (“CMP”) to manage the use of cookies and similar technologies, in accordance with applicable European Union (“EU”) and United Kingdom (“UK”) data protection and privacy laws. When you first visit our Services from the EU or UK, you will be presented with a cookie banner allowing you to accept or reject non-essential cookies by category. Cookies are grouped as follows:
      1. Strictly necessary cookies: which are required for the operation, security, and core functionality of the Services (such as page navigation and form submission).
      2. Preferences or functionality cookies: which remember your choices (such as language or region) and enhance your experience.
      3. Analytics cookies: which help us understand how users interact with our Services (for example, by collecting aggregated information about visits, traffic sources, and usage patterns).
      4. Marketing, advertising, or social media cookies: which may be used to deliver content, measure campaign effectiveness, or enable social media features.
    9. We only place analytics, marketing, advertising, or social media cookies (or allow third parties to do so) where you have given your consent via the CMP, unless otherwise permitted by applicable law.
    10. You may control or disable cookies through your browser settings. Most browsers allow you to refuse cookies, delete cookies, or receive alerts before cookies are placed. However, certain features of our Platform may not function properly if cookies are disabled. If you access our services via a mobile device, your device settings may also allow you to restrict the collection of location data or other device-based identifiers.
    11. We will obtain your consent before using any non-essential cookies where required by applicable law. You may withdraw your consent at any time by adjusting your browser settings or contacting our Data Protection Officer.
    12. Change of purpose
    13. We will only process your Personal Data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose.
    14. If there is any change in the purposes for which we collect your Personal Data, we will inform you of such change by way of posting the changes on our Platform. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact our Data Privacy Officer at the contact details provided under paragraph 13. Where required by law, we will obtain your consent before using your Personal Data for a new purpose that is not compatible with the original purpose for which it was collected.
  4. DISCLOSURE OF INFORMATION
    1. We may disclose your Personal Data to our affiliates and third parties where necessary for the purposes set out in this Privacy Policy or as permitted or required under the PDPA 2012 and other applicable laws. Such disclosures may include:
      1. Affiliates and related entities, to support our operations, event organisation, customer management, marketing, administrative functions, and other business purposes.
      2. Service providers and professional advisers, to support third-party vendors, agents, and contractors engaged to perform services for us or on our behalf, including event registration and administration, medical and safety support, event photography (where consent has been provided), time-keeping, payment processing, hosting, analytics, compliance, marketing, cloud services, and other operational or advisory services. Where required, such parties will be contractually bound to process personal data only in accordance with our instructions and to protect such data appropriately.
      3. Legal, regulatory, and law-enforcement authorities, such as government agencies, regulators, law-enforcement bodies, or other parties where disclosure is required or permitted by law, or where we consider such disclosure reasonably necessary to protect our rights, enforce our terms, detect and prevent fraud or security incidents, respond to emergencies, or protect the safety, rights, or property of our participants, customers, employees, or the public.
      4. Corporate transaction counterparties, such as actual or prospective purchasers, investors, financiers, assignees, or other relevant parties in connection with any merger, acquisition, sale or purchase of assets, restructuring, reorganisation, financing, insolvency or bankruptcy proceedings, or other corporate transactions. Personal data may be transferred as part of such transactions in compliance with the PDPA.
      5. Cross-border transfers, such as when personal data is transferred outside Singapore, we will ensure that the receiving party is legally bound to protect the personal data at a standard comparable to the PDPA, whether through contractual obligations or other legally enforceable mechanisms
    2. We do not disclose your Personal Data to unaffiliated third parties for their independent use unless we have obtained your express consent to do so and pursuant to executing confidentiality agreements with such unaffiliated third parties. We also require all third parties to respect the security of your Personal Data and to treat it in accordance with the law.
    3. We partner with SportSG for the organisation, regulation, administration, and oversight of the Event and related activities. Accordingly, and for the purposes set out in this Privacy Policy, we may disclose or transfer your Personal Data to SportSG where such disclosure is necessary for event administration and operational coordination, public safety, security, medical, or emergency management, regulatory, compliance, reporting, contractual or audit requirements and obligations.
    4. Please note that SportSG is a public agency for the purposes of PDPA 2012. Under section 4(1)(c) of the PDPA 2012, the obligations in Parts III to VI of the PDPA 2012 do not apply to public agencies. Once Personal Data is disclosed to SportSG, it will be governed by SportSG’s own data-governance policies and applicable public-sector rules and regulations. Your statutory rights of access, correction, withdrawal of consent, or data portability apply only to Personal Data in our possession or under our control, and not to Personal Data that has been transferred to SportSG.
    5. Where your consent is required before we may disclose any Personal Data to SportSG, we will ensure that you are informed of the purpose of such disclosure.
  5. RETENTION OF INFORMATION
    1. We only retain your Personal Data for as long as is necessary for us to process your Personal Data for the administration of the Event and the provision of the Services. However, please be advised that we may retain some of your Personal Data after you cease to use our Services or be engaged in our Event, for instance, if the data is necessary to meet our legal obligations, such as retaining the information for tax and accounting purposes.
    2. In some circumstances we may anonymise your Personal Data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you. When your Personal Data is no longer required for the purposes for which it was collected, or for any legal or business purpose, we will ensure that such data is securely deleted, anonymised, or otherwise disposed of in a manner that prevents unauthorised access or disclosure.
  6. MARKETING AND OPTING OUT
    1. We may contact you using your personal data for transactional, administrative, or race-operations purposes (including service updates, event logistics, safety notices, account matters, or other essential communications). These communications are necessary for the provision of our Services and are not marketing in nature. You will continue to receive such communications where relevant, even if you have opted out of marketing messages.
    2. Where you have given your consent in accordance with applicable data protection laws (including the PDPA and Do Not Call provisions), we may use or share your personal data with organisations that are our business partners to contact you by mail, telephone, SMS, or email about our Services, Events, or related offerings that may be of interest to you.
    3. You may opt out of receiving marketing communications or withdraw your marketing consent at any time:
      1. by clicking the “Unsubscribe” link included in our marketing emails;
      2. by following the opt-out instructions provided in SMS or other marketing messages; or
      3. by contacting us through the channels specified in this Privacy Policy.
    4. Upon opting out or withdrawing consent, we will cease processing your personal data for direct marketing purposes as soon as reasonably practicable. This will not affect the processing of your personal data for transactional or operational communications, or where otherwise permitted or required by law.
  7. INTERNATIONAL TRANSFERS OF INFORMATION
    1. We may transfer your Personal Data to countries outside Singapore. Where we do so, we will take steps to ensure that your Personal Data continues to receive a standard of protection that is at least comparable to that provided under the PDPA. This may include entering into data transfer agreements with the recipient based on contractual clauses approved by the Personal Data Protection Commission of Singapore (the “PDPC”) or relying on exceptions under applicable law (such as your consent).
  8. SECURITY
    1. Our management and its teams take commercially reasonable precautions to keep all information obtained from our online visitors secure against unauthorised access (e.g., a data breach), collection, use, disclosure, copying, modification, or disposal, or similar risks, and we periodically review our security measures. 
    2. While no Platform or online service can guarantee complete security, we continuously review and improve our safeguards to maintain a level of protection that is reasonable and appropriate under the PDPA.
    3. You are responsible for keeping your login information and passwords confidential. SGIMPL adheres to established IT and data security policies and implements industry best practices across our infrastructure. Our cloud environments are continuously monitored for misconfigurations and vulnerabilities, and we have implemented measures such as distributed denial-of-service (DDoS) protection, secure VPN access, and access controls to safeguard internal resources. We also enforce encryption (at rest and in transit), user authentication, and conduct regular reviews of system access to maintain strong security standards. However, please be aware that these protection tools do not protect information that is not collected through our Platform, such as information provided to us by e-mail.
    4. If a data breach occurs that could cause harm or affect many people, we will assess the situation and notify the Personal Data Protection Commission and the affected individuals where required by law.
    5. If you believe your account or Personal Data may have been compromised, please contact our Data Protection Officer immediately.
  9. MAKING CHANGES TO YOUR PERSONAL DATA
    1. You have the right to request access to or correction of the Personal Data that we hold about you.
    2. To do so, please submit your request in writing to our Data Protection Officer at the contract details provided under paragraph 13. We will respond to your request as soon as reasonably possible. Where permitted by law, we may charge a reasonable administrative fee to cover the cost of processing your access request.
    3. If we are unable to respond to your request within 30 days, we will inform you in writing of the time by which we can respond.
    4. You should ensure that all Personal Data submitted to us is accurate, complete, and up to date. We will take reasonable steps to ensure that any Personal Data in our possession is accurate and complete if it is likely to be used to make a decision affecting you or disclosed to another organisation.
  10. LINKS TO OTHER SITES
    1. Our Platform may contain links to other sites. These sites are not covered by this Privacy Policy, and we are not responsible for the privacy practices or the content of these sites.
  11. CHANGES TO THE PRIVACY POLICY
    1. We reserve the right to modify this Privacy Policy and related business practices at any time by posting updated text on this page. Please check this page periodically for updates. Your continued use of our Platform and Services constitutes your acknowledgement and acceptance of such changes.
  12. GOVERNING LAW
    1. This Privacy Policy shall be governed and construed in accordance with the laws of the Republic of Singapore. Any dispute arising out of or in connection with this Privacy Policy including any question regarding its existence, validity, or termination, shall be referred to and finally resolved exclusively by the courts of Singapore.
